Assault
Although assault is commonly known as an attempted battery, assault is defined as an apprehension or fear of such touching. This definition is a little misleading, however, especially in light of people being charged with assault with a deadly weapon, as well as with assault with intent to commit great bodily injury, commonly known as GBI. These violations are actual batteries, where a contact has occurred usually resulting in injuries that actually may be very severe.
An assault may be filed as a misdemeanor or as a felony, depending on the actual facts of the case, such as the type of attack, the weapon used if any, the duration of the attack and the severity of the injuries to the victim.
