Two defendants charged in a massive 60 plus defendant insurance fraud case.  Each defendant was charged with more than 20 felony counts of insurance fraud.  The criminal defense attorneys of Gurovich, Berk & Associates settled both defendants to amended counts for a charge other than insurance fraud which will be reduced to a misdemeanor after 18 months.  NO JAIL!

Represented client in a multiple defendant Federal Healthcare Fraud case and convinced the Assistant United States Attorney prosecuting the case that he cannot prove his case.  Case Dismissed!

Owners of Pharmacy investigated by FBI for fraud by way of phantom billing, billing for services not rendered, and billing for services not medically reasonable and necessary.  After early intervention by our criminal defense attorneys, the FBI and US Attorney’s Office were convinced that it would be difficult to take the case to trial and the case was never filed.

A client was arrested for DUI (marijuana intoxication).  The arresting officer observed the defendant smoke a marijuana pipe.  Moreover, that same officer conducted a field sobriety test and determined that the Defendant was under the influence of marijuana.  The Defendant immediately retained the services of Gurovich, Berk & Associates.  After careful examination of the chemical evidence along with the arresting officers observations, the case was voluntarily dismissed by the Los Angeles District Attorney’s Office. Dentist was arrested by the Department of Justice and charged with one count of Grand Theft (in excess of $50,000), one count of Presenting False Medi-Cal Claims, one count Receiving Unlawful Medi-Cal Remuneration, and once count of unlawful Rebated for Patient Referrals (capping).  Subsequent to a lengthy and exhaustive investigation by attorneys Dmitry Gurovich and Elon Berk, the Attorney General’s Office agreed to dismiss the first 3 counts and settle the case for a plea to the Cappig charge without and jail/custody commitment. Client was arrest for grand theft by way of embezzlement from her employer.  The allegation was that she embezzled in excess of $400,000.  After a thorough audit and an investigation into all aspects of the case by the criminal attorneys of Gurovich, Berk & Associates, the loss amount was reduced to a little more than $20,000.  Our criminal defense team developed a theory that was presented to the Beverly Hills Police Detectives and the District Attorney’s Office that the alleged victim was likely committing tax fraud and attempted to cover up his fraud by alleging that all the cash proceeds of the business were embezzled by our client.  After a lengthy negotiations, the criminal lawyers of Gurovich, Berk & Associates settled the case where our client made full restitution (only $20,000) and she was sentenced to 3 years of probation WITHOUT ANY JAIL TIME.  The case will be reduced to a misdemeanor upon completion of probation.

Client was arrested with co-defendants for a first degree burglary (a person was present at the home at the time of the burglary, a Strike offense in California).  Client had prior juvenile convictions for theft offenses including a prior burglary.  Initial offer from the District Attorney was for 9 years.  The client was, initially, represented by the Public Defender’s office.  Once the criminal attorneys of Gurovich, Berk & Associates substituted into the case, they convinced the prosecutor that the initial 9 year offer was not proper for this case.  Furthermore, our criminal lawyers were able to secure additional discovery and convinced the District Attorney’s office that the client deserved a lesser sentence even though he had prior similar convictions.  Although the co-defendant in the case took an early deal for 365 days in the County Jail, our attorneys secured a 60-days of community service, NO JAIL.

Two clients were arrested in Bakersfield, CA for Health Care Fraud worth over 1 million.  After the criminal defense lawyers of Gurovich, Berk & Associates intervened, the California Attorney General’s Office agreed to reduce the charges to a minor misdemeanor and NO JAIL.
